The U.S. Court of Appeals for the Eleventh Circuit has ruled to invalidate an order by the U.S. Department of Transportation requiring Delta Air Lines and Aeromexico to dissolve their joint venture.
The U.S. Department of Transportation had ordered the two airlines to end their joint venture effective January 1 of this year. The department said that recent measures by the Mexican government—such as banning all-cargo flight operations at Mexico City International Airport and reducing capacity—had created an unequal competitive environment and caused tangible harm to users. It said it would reassess the matter if conditions improve, while continuing to allow their codeshare partnership.
In response to the ruling, Delta Air Lines commented: “For nearly a decade, our joint venture agreement with Aeromexico has provided consumers with more choices, seamless travel, and enhanced connectivity, while supporting U.S. jobs and economic growth. We appreciate the Eleventh Circuit’s careful review and remain focused on ensuring that our customers, employees, and communities continue to benefit from this longstanding partnership.”
