Austrian Authorities Tighten Visa-Free Stay Regulations for Japanese Nationals
The Austrian authorities have tightened the regulations for visa-free stays for Japanese nationals starting October 22.
Japanese nationals can stay visa-free in the Schengen area, including Austria, for up to 90 days within the past 180 days based on the Schengen Agreement. Meanwhile, under the visa exemption agreement between Japan and Austria, they can stay for up to six months in Austria alone for purposes such as visits, tourism, or business trips.
In this case, if they leave the Schengen area after staying more than 90 days visa-free, they will not be allowed to re-enter Austria unless they stay outside the Schengen area for more than 90 days or obtain a D visa. Furthermore, the period for which they can stay visa-free is limited to a maximum of 180 days within the past 360 days.
Additionally, those who enter Austria visa-free with the intention to settle will not be subject to the visa exemption agreement. Moreover, once they apply for a residence permit in Austria, they are generally considered to have the intention to settle. If the date of receiving the residence permit exceeds 90 days from the date of entry, it is recommended to inquire with the district police in advance whether staying beyond 90 days is possible.
The Japanese Embassy in Austria advises caution when visiting Austria visa-free or when applying for a residence permit after entry.
